The Prosecutors’ Section of Romania’s top judicial watchdog CSM postponed for November 19 the hearing of General Prosecutor Augustin Lazar, in the view of the dismissal recommendation issued by the Justice Minister Tudorel Toader.

Top Judicial Watchdog Postpones Hearing On Dismissal Of General Prosecutor

The initial hearing was scheduled for November 13.

CSM representatives announced that the postponement was approved following request made by both parties.

However, Justice Minister Tudorel Toader later stated in a Facebook post that only the general prosecutor requested the postponement, with no such request made by his ministry.

The Prosecutors’ Section review on the dismissal proposal is non-binding, and the minister could forwards the proposal to President Klaus Iohannis even if it receives a negative review, as it previously happened with a similar request against former anticorruption chief Laura Codruta Kovesi.

Justice Minister Tudorel Toader announced on October 24 that he will launch the procedure to dismiss General Prosecutor Augustin Lazar from office, after criticizing his activity in a 20-point assessment.

The minister’s reasons for launching the request varied from procedural problems in Lazar’s appointment to the office in 2016, to the fact that he criticized the recent formation of a section to investigate magistrates.

In the announcement, Toader stated that upon documenting the prosecutor’s nomination for the office in 2016, he found that it a lacked a mandatory review on his recent activity, and that when he requested a copy from the country’s top judicial watchdog, CSM, it was dated one year after the decree which appointed Lazar as general prosecutor.
