Romanian Govt Amends Law Regulating Constitutional Court’s Activity

Romania's Parliament currently has two chambers, namely the Senate and the Chamber of Deputies, and a minimum of 50 deputies and 25 senators is needed to notify the Constitutional Court.

The current law regulating the activity of the Constitutional Court states that the institution rules on the constitutionality of laws before they are promulgated and after the court receives a notification from the head of state, from one of the heads of the two chambers, the Government, the High Court of Justice, the Ombudsman, as well as from a minimum of 50 deputies and 25 senators.

The Constitutional Court also rules on the constitutionality of treaties and other international agreements after being notified by one of the two Parliament chambers' heads and at least 75 lawmakers (senators and deputies). The court also needs a notification from at least 50 deputies and 25 senators to rule on the constitutionality of Parliament's regulation.

The draft law revising the Constitution states that that at least 40 lawmakers are required to notify the Constitutional Court regarding the abovementioned issues.

Romania's Government decided Wednesday to put forward a draft law for the revision of the Constitution, providing for a single-chamber Parliament and a maximum of 300 MPs, which was forwarded to the head of state. The single chamber will be called the House of Representatives and will comprise up to 300 MPs.
