Romania’s Supreme Court decided Friday to suspend the trial of former transport minister Miron Mitrea on corruption charges and send the case to the Constitutional Court, which is to analyze several exceptions that were raised in this trial.

Romanian Supreme Court Suspends Trial Of Ex Transp Min, Sends Case To Constitutional Court

The panel of nine judges of the Supreme Court admitted Friday the appeal made by Irina Paula Jianu, who is tried in this case together with social democrat Miron Mitrea, against the decision of July 10, by which the criminal department of the court rejected several exceptions of unconstitutionality that were brought up by her lawyer.

The nine magistrates decided to suspend the trial and send the file to the Constitutional Court, which should verify the exceptions raised by Irina Jianu’s lawyer.

On Friday, her lawyer said the judges from the Criminal department did not appreciate correctly that Government Emergency Ordinance 134/2005 amending Government Emergency Ordinance 43/2002 on the National Anticorruption Court (the National Anticorruption Department at present–e.n.) would still be valid.

Gabriela Ghita, Jianu’s lawyer, said the ordinance she mentioned is still valid, is connected to the cause and can be submitted to constitutional verification.

Another exception regards the unconstitutionality of some articles of the Criminal Procedure Code on wire tapping and ways to make use of it.

The criminal department of the Supreme Court rejected on July 10 the exceptions of unconstitutionality raised in Miron Mitrea's file.

Jianu appealed the decision at the Supreme Court.
