EXCLUSIVE: Romanian Court Rules To Cancel Recalculation Of Military Staff Pensions

On January 7, the Romanian High Court of Justice ruled to suspend the application of a Government decision on recalculating the pensions of military staff, police officers and public servants with special status, who work in penitentiary administration.

The High Court of Justice's decision was definitive and upheld a decision ruled by the Cluj Court of Appeals on September 28, 2010.

End-January, the Government approved an emergency ordinance which changed the way the pensions of former military personnel are calculated.

The recalculation method sets that pensions will be recalculated based on the gross average wage per economy instead of individual income until the end of this year and institutions in the defense system have until end-October to send affidavits to pension houses regarding income gained by retired employees, according to the decree.

The emergency decree was adopted after the Constitutional Court ruled unconstitutional the Governemnt decision on recalculating the pensions of military and public order personnel.
