Harassment Sentences Changed In New Romanian Criminal Code

Harassment represents "the action of the individual who repeatedly pursues, without right or legitimate interest, another individual, or monitors the home, workplace or other locations frequented by the latter, thus causing distress, is punishable by a three to six months prison sentence or a fine."

According to Article 208, section 2, "the initiation of telephone calls or remote communications means, which, by frequency or content cause distress to an individual, is punishable by a three to six months prison sentence or a fine, if the deed does not constitute a felony.

Section three states that criminal action is only initiated after a complaint filed by the victim.

Article 207 of the new Criminal Code defines blackmail, respectively “forcing an individual to offer, or to do or not to do something with the purpose of gaining unjust patrimonial uses, for one’s self or for another”, a deed punishable by a one to five year prison sentence.

Blackmail, in the new Criminal Code, entails a lower minimum sentence, respectively from six months to five years imprisonment.

Section two of the same article states punishment will be applied for deeds where an individual threatens to expose a real or imaginary deed, compromising for the individual threatened or for one of their family members.

If the deeds mentioned are committed in order to obtain unjust benefits, the punishment limits grow to two to seven years imprisonment, according to section three. This section can only be found in the new Criminal Code, as the old one did not contain such provisions.
