Supreme Court Rules Against Preventive Arrest Warrant Of Prosecutors Involved In Rigging Contest

 

The Supreme Court Wednesday discussed in a secret meeting the proposal of preventive arrest issued in the name of the two prosecutors and notary public Bucur. Debates lasted for three hours.

 

The National Anticorruption Department Tuesday asked the approval of the prosecutors’ section within the Supreme Council of Magistrates to arrest Dumitru Gheorghe, prosecutor of the Prosecutors’ Office with the Pitesti Court of Appeals, candidate for filling in the management position of the Prosecutors’ Office and of Eugen Cojocaru- prosecutor within the Supreme Court and member of the examination commission.

 

 

The five magistrates are: Dumitru Gheorghe, prosecutor of the Prosecutors’ Office with the Pitesti Court of Appeals, Sterian Guli, prime prosecutor of the Prosecutors’ Office with the Urziceni Courthouse,  Gheorghe Cerbeanu, judge at the Valcea Court, Gheorghe Bucur, notary public in Bucharest and Gabriela Ghita, prosecutor of the Prosecutors’ Office with the Supreme Court  and chairman of the commission examining participants in the contest to fill chief prosecutor and judge positions.  

 

From the evidence brought forth by prosecutors it resulted that in October 2007, Gheorghe Dumitru, candidate in the test to fill in the position of general prosecutor within the Prosecutors’ Office with the Pitesti Courthouse, in order to be sure he occupies the position offered to former magistrate Bucur Gheorghe several goods, with the help of judge Cerbeanu Gheorghe. In exchange, Gheorghe said he would talk to one of the members of the High Council of Magistrates to make sure Dumitru got the position.

Moreover, the candidate gave prosecutor Cojocaru Eugen, member of the examination commission, EUR15,000 consisting in bribe, to occupy the desired position.

 

Following the contest, Gheorghe Dumitru, occupied first position in the exam to fill in the position of general prosecutor within the Prosecutors’ Office of the Pitesti Court of Appeals.

 

The evidence also reads that in November 2007, chief prosecutor Guli Sterian, candidate to occupy the position of prime prosecutor within the Prosecutors’ Office of the Bucharest Court obtained, with the help of Cojocaru Eugen-president of the examination commission, Ghita Georgeta Gabriela-member in the examination commission, some of the test subjects before the exam was given.
