Romanian Draft Civil Procedure Code Simplifies Divorce Procedures

The Romanian draft Civil Procedure Code presented Thursday by resigning justice minister Tudor Chiuariu simplifies the divorce procedure through party agreement, thus courts might be handle less such trials, while civil registry offices will acknowledge the separation of the couple.

Chiuariu says that the new Civil Procedure Code allows the introduction of divorce "through administrative means," at the civil registry office, where mutual consent will be invoked, if the spouses do not have underage children, born within the marriage or adopted by both spouses.
The measure is based on the fact that "nothing justifies the burdening of court activities with administrative procedures," Chiuariu stated.
At the same time, the new Civil Procedure Code introduce the procedure of divorce based on request accepted by the defending party, while regulations also target divorce based on long separation (at least five years), long detention periods and reasons regarding the health of one of the spouses.
