According to the Court's ruling, the former general must be released from prison starting Wednesday to undergo open heart surgery.

The National Forensic Medicine Institute showed Chitac cannot be operated on in hospitals belonging to the penitentiary system.

The Court also decided that, in the 60-day release interval, Chitac is forbidden to wear weapons and change his residence without previously announcing military judges.

On October 16, 2008, Romania's High Court of Justice sentenced Chitac and Romanian former general Victor Athanasie Stanculescu to 15 years in prison for aggravated manslaughter during the 1989 revolution.
