At the Thursday hearing, Tartoussi’s lawyer, Ionel Hasotti, said he does not acknowledge the jurisdiction of the trial judge. The lawyer argued that the Constanta Court of Appeals and not the Bucharest Court of Appeals should try the case.
A second lawyer, Ioan Cazacu, argued that the judge appointed in this case ruled the illegal arrest of Hayssam in 2005 with the High Court of Justice and thus he cannot be deemed “impartial” in the pursuit of this matter.
Another panel of judges will rule on the request of the two lawyers. The meeting will be resumed in two hours.
The Bucharest Court of Appeals on Thursday had to rule on the prosecutor’s request to deny Tartoussi the right to leave the country.
Iman T cargo ship captain Youssef Abd Al-Razzaq Tartoussi admitted having received EUR800 from Omar Hayssam, sentenced by a Bucharest court to 20 years in jail for the kidnapping of three Romanian journalists in 2005 in Iraq, to help him evade the authorities by hiding in one of the ship’s cabins.
