Court Allows Medical Expertise For Romanian Ex General Stanculescu

The Bucharest Military Court allowed Tuesday the request made by Victor Athanasie Stanculescu for a medical expertise at the National Forensic Medicine Institute, meant to establish of Stanculescu can carry out his 15 year sentence in prison.

The court discussed the request made by Victor Athanasie Stanculescu to discontinue his 15-year prison sentence, as medical examinations indicated that he, as well as Mihai Chitac, suffer from chronic illnesses.

The court allowed the request submitted by Stanculescu’s lawyer, Alice Draghici, for an expertise performed by the National Institute for Forensic Medicine "Mina Minovici" regarding the former general’s state of health.

The judge said the institute will have to clearly state if Stanculescu’s condition could render him unable to carry out his sentence.

"The institute should clearly state if the illness is severe and if it can render the inmate unable to carry out his sentence in prison, in accordance with article 453 letter a and article 455 of the Criminal Procedure Code," said the judge.

At the same time, Stanculescu’s lawyer asked the court to issue a request for Stanculescu’s medical records.

The court will meet in session on November 4.

The two former generals were imprisoned when the court rejected their appeals on October 15 and they were sentenced to 15 years imprisonment in the Revolution case.
