Serban Bradisteanu, head of the cardiovascular department of Bucharest's Floreasca hospital, said Chitac was in serious condition and tests showed surgery posed a high risk. For this reason, the patient and his family decided to postpone the operation.

Chitac was released for 60 days on May 5 by the Bucharest Military Court of Appeals to undergo heart surgery. The National Forensic Medicine Institute showed at the time that Chitac cannot be operated on in hospitals belonging to the penitentiary system.

On October 16, 2008, Romania's High Court of Justice sentenced Chitac and former general Victor Athanasie Stanculescu to 15 years in prison for aggravated manslaughter during the 1989 revolution.
