The Legal Committee of Romanian Senate on Wednesday approved an amendment to the Criminal Procedure Code which absolves journalists from criminal responsibility over disclosed audio and video recordings.

Romanian Journalists Not Liable For Footage Disclosure

The Committee debated a request made by President Traian Basescu to amend the Criminal Procedure Code so that journalists who publish audio or video materials obtained without infringement of the professional deontology will not be legally prosecuted for publishing the materials.

Basescu criticized an article of the Code, which punished stealing, destroying or keeping correspondence, as well as disclosing its content, even in the event when such correspondence was sent open or it was opened by mistake. In addition, the article punished any disclosure of a conversation or communication, audio or video, which was illegally intercepted, even if the doer becomes aware of it by mistake or by chance.

The Committee eliminated from the article’s text the term “audio or video recordings” to render void any possible suspicions regarding the legal responsibility of journalists.
