The draft law revising Romania’s Constitution stipulates that the President has immunity over the course of his/her term, a change from the current Constitution, which does not provide the length of immunity and makes reference to immunity from prosecution for political opinions.

Romanian President Has Immunity During Term – Draft Revised Constitution

"Over the course of his/her term, the President of Romania has immunity," says article 84 section 2 of the draft act revising the Constitution. The same section of the current Constitution reads: "The President of Romania has immunity. The provisions of article 72 section (1) apply accordingly."

Article 72 section 1 of the current Constitution stipulates that deputies and senators may not be prosecuted for votes or political opinions expressed during their term.

Romania's Government has decided to put forward a draft law for the revision of the Constitution, providing for a single-chamber Parliament and a maximum of 300 MPs, which was forwarded to the head of state.
