Top Anticorruption Body Vacates Two Lead Offices Following Government Judicial Decree

Romania’s National Anticorruption Directorate (DNA) will have to fill vacancies for lead offices in its anticorruption and criminal sections, after top judicial watchdog CSM rejected its request to extend the delegations of their chief prosecutors, following the recent Government judicial decree.

CSM announced that it rejected the request as the decree forbids delegations into prosecutor roles which are formally appointed by the country’s president.

The chief prosecutors verify the legality and solidity of cases handled by their respective sections, among other responsibilities.

The judicial watchdog warned that the duration of the vacancies could not be determined and that the decree negatively impacts the functioning of the country’s judiciary.

Romanian Justice Minister Tudorel Toader announced on Monday that the Government will repeal article 54 of the recent decree, which allowed judges to lead main prosecuting bodies and amended the review process for appointing top prosecutors.

The minister said that the decision was taken following talks with magistrates on Monday held by Prime Minister Viorica Dancila, and that the law will be reverted to its previous version.

He added that the repeal decree is scheduled to be adopted during next week’s cabinet meeting, and that a full repeal of the decree was out of the question.
